I would guess that they are planets, somewhat transparent planets. That's at least what I believe them to be.

If you say the game doesn't follow conventional physics, then you have to redefine your notion of a black hole. Can't talk about black holes without physics, so that sentence ends up being meaningless.

It means it may be true, after you account for the necessary modifications to the definition of a black hole with these physics, as PONTO pointed out.  It, however, does not mean that it must be true.

Incidentally, the ball goes down in the game, implying that the game takes place in a gravity well.

The birds themselves are time-frozen, but they can still drift and rotate through space.  You won't see them flapping their wings or anything though.
