AFAIK, it's fine to use tilesets from the public tileset library, or that have been posted for public use, it's only if they've been lifted from another person's level that permission is required. It seems kinda weird to re-make a tileset into something almost identical but different just to make sure you aren't stealing, but that seems like it may be the only option if you can't get the author's consent.
